STANDING CROP OF BARLEY at Fenwick, Northumberland 49.31 hectares (121.84 acres) of Safron Winter Barley sprayed in the autumn with herbicide, sprayed in the spring once with fungicide and trace elements and then again with fungicide, trace elements and growth regulator. Offers Invited SALE OF STANDING CROP Fenwick, Northumberland Terms and Conditions 1 These particulars are deemed an invitation to view and no appointment is necessary. 2 The tender date is Monday 12 July 2010 at 12 noon. 3 The plan attached is for identification only and indicate approximate boundaries of the fields. 4 The land is offered as seen and any intending Purchasers must satisfy themselves as to the extent and quality of the land. Tenders will be considered on a total price, NOT price per acre. 5 Upon notification of a successful tender the buyer must indemnify the crop to his own requirements also ensuring any third party losses are covered. The proprietor will no longer sustain any liability for the crop. 6 The Purchaser must ensure that such agricultural activity as is required keeps the Land in good agricultural and environmental condition (“GAEC”) and to ensure compliance with Statutory Management Requirements (“SMRs”) as defined and required by the provisions of Council Regulation (EC) 1782/2003 and such European and domestic legislation introduced pursuant to that Regulation, or any statutory modification or re-enactment thereof for the time being in for force. The Purchaser must not compromise the proprietors SFP and will be liable to the proprietor should he do so. 7 The Purchaser is to be responsible for and to control the Land in terms of management, benefit and financial risk. 8 The Purchaser must maintain all fixtures and fittings, fences, gates and drains and repair all damage arising from use of the land. 9 The Purchaser must use a conventional combine, straw maybe chopped or baled but must ensure a clean stubble is left after the crop is taken. 10 The Purchaser if baling the straw must remove all bales from the land within 1 week of combining, unless by prior arrangement through Hexham and Northern Rural. 11 Payment terms: 50% by Monday 2 August 2010 and 50% by Wednesday 15 September 2010. 12 The Proprietor has no obligation to take the highest or indeed any offer. 13 Any dispute will be at the sole resolution of the agents – Hexham and Northern Rural.
